GENERAL PROVISIONS
- The Data Controller of personal data collected via the websites www.app.disc-golf.pl and disc-golf.pl is KIWICO PAWEŁ SŁOTWIŃSKI, place of business: Byka 5/21, Poznań, delivery address: ul. Byka 5/21, Poznań, NIP (Tax ID): 7831837365, REGON (Business ID): 388993397, e-mail address: ps.slotwinski@gmail.com, hereinafter referred to as the „Controller”.
- Personal data collected by the Controller via the websites are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the „GDPR”, as well as the Personal Data Protection Act of 10 May 2018.
TYPE OF PERSONAL DATA PROCESSED, PURPOSE AND SCOPE OF DATA COLLECTION
- PURPOSE OF PROCESSING AND LEGAL BASIS. The Controller processes personal data via the websites app.disc-golf.pl and disc-golf.pl in the event of:
- registration or use of the contact form by the user. Personal data is processed on the basis of Art. 6(1)(f) of the GDPR as a legitimate interest of the Controller.
- subscription to the Newsletter by the user for the purpose of sending commercial information electronically. Personal data is processed upon distinct consent, on the basis of Art. 6(1)(a) of the GDPR.
- TYPE OF PERSONAL DATA PROCESSED. The Controller processes the following categories of the user’s personal data:
- Name and surname,
- E-mail address,
- Telephone number,
- PERIOD OF PERSONAL DATA RETENTION. Users’ personal data is stored by the Controller:
- where the basis for data processing is the performance of a contract, for as long as it is necessary to perform the contract, and after that time for a period corresponding to the limitation period for claims. Unless a specific provision states otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to conducting business activity – three years.
- where the basis for data processing is consent, until the consent is withdrawn, and after the withdrawal of consent for a period of time corresponding to the limitation period for claims that may be raised by the Controller and that may be raised against them. Unless a specific provision states otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to conducting business activity – three years.
- While using the website, additional information may be collected, in particular: the IP address assigned to the user’s computer or the external IP address of the Internet provider, domain name, browser type, access time, operating system type.
- Navigation data may also be collected from users, including information about links and references they decide to click or other actions taken on the website. The legal basis for this type of activity is the legitimate interest of the Controller (Art. 6(1)(f) of the GDPR), consisting in facilitating the use of services provided electronically and in improving the functionality of these services.
- Provision of personal data by the user is voluntary.
- Personal data will also be processed in an automated manner in the form of profiling, provided that the user consents to this based on Art. 6(1)(a) of the GDPR. The consequence of profiling will be the assignment of a profile to a given person in order to make decisions regarding them or analyze or predict their preferences, behaviors, and attitudes.
- The Controller shall take special care to protect the interests of data subjects, and in particular ensures that the data collected by them is:
- processed lawfully,
- collected for specified, legitimate purposes and not subject to further processing incompatible with these purposes,
- factually correct and adequate in relation to the purposes for which it is processed, and stored in a form allowing identification of the data subjects, for no longer than is necessary to achieve the purpose of processing.
SHARING OF PERSONAL DATA
- Users’ personal data is transferred to service providers used by the Controller in running the website. The service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, either act under the instructions of the Controller regarding the purposes and methods of processing this data (processors) or independently determine the purposes and methods of their processing (controllers).
- Users’ personal data is stored exclusively within the European Economic Area (EEA).
RIGHT TO CONTROL, ACCESS, AND RECTIFICATION OF OWN DATA
- The data subject has the right to access the content of their personal data and the right to rectify, delete, restrict processing, the right to data portability, the right to object, the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
- Legal grounds for the user’s request:
- Access to data – Art. 15 of the GDPR
- Rectification of data – Art. 16 of the GDPR.
- Erasure of data (right to be forgotten) – Art. 17 of the GDPR.
- Restriction of processing – Art. 18 of the GDPR.
- Data portability – Art. 20 of the GDPR.
- Objection – Art. 21 of the GDPR
- Withdrawal of consent – Art. 7(3) of the GDPR.

- In the event of a user exercising a right arising from the above, the Controller fulfills the request or refuses to fulfill it immediately, but no later than within one month after receiving it. If, however – due to the complex nature of the request or the number of requests – the Controller cannot fulfill the request within a month, they will fulfill it within the following two months, informing the user in advance, within one month of receiving the request – of the intended extension of the deadline and its reasons.
- If it is determined that the processing of personal data violates the provisions of the GDPR, the data subject has the right to lodge a complaint with the President of the Personal Data Protection Office.
„COOKIES”
- The Controller’s website uses „cookies”.
- The installation of „cookies” is necessary for the proper provision of services on the website. Cookies contain information necessary for the correct functioning of the website, and they also provide the opportunity to compile general statistics of website visits.
- The website uses types of „cookies”: session and persistent.
- „Session” cookies are temporary files stored on the user’s terminal device until logging out (leaving the website).
- „Persistent” cookies are stored on the user’s terminal device for the time specified in the cookie file parameters or until they are deleted by the user.
- The Controller uses their own cookies to better understand how the user interacts with the website content. These files collect information on how the user uses the website, the type of website from which the user was redirected, and the number of visits and time of the user’s visit to the website. This information does not record specific personal data of the user, but serves to develop statistics on website usage.
- The user has the right to decide on the access of cookies to their computer by pre-selecting them in their browser window. Detailed information about the possibilities and methods of handling cookies is available in the software (web browser) settings.
FINAL PROVISIONS
- The Controller applies technical and organizational measures ensuring the protection of processed personal data appropriate to the risks and categories of data covered by protection, and in particular secures data against their disclosure to unauthorized persons, acquisition by an unauthorized person, processing in violation of applicable regulations, as well as alteration, loss, damage or destruction.
- The Controller provides appropriate technical measures preventing unauthorized persons from obtaining and modifying personal data sent electronically.
- In matters not regulated by this Privacy Policy, the provisions of the GDPR and other relevant provisions of Polish law shall apply accordingly.
